A California high school student has been suspended for making rude remarks about a teacher on Facebook. The ACLU is claiming that Tobolski’s right to free speech has been violated and says that the school broke both federal and state laws.
The ACLU stated in a letter to the school that Donny’s Facebook post was “protected under the state and federal constitutions as well as the Education Code.”
The posting came after a biology teacher assigned Tobolski what he considered a large amount of homework. In response, the young man posted that the teacher was a “fat ass who should stop eating fast food, and is a douche bag.” The posting was done from home and not during school hours.
Do you think a school has a right to discipline a student for rude remarks on Facebook, if those comments don’t include physical threats or violence?
